Can you rent a car with a DUI on your driving record?

No, you cannot rent a car from Avis if your driving record shows a DUI within the last 48 months or if your license has been suspended. This policy also applies to DWAIs and DWIs. 

However, if the DUI conviction is from more than 48 months ago and there are no other disqualifying incidents on your record, you can rent from Avis.

 

How Your Driving Record Affects Car Rental Eligibility

Drivers who wish to rent a car from Avis will need to present a valid driver’s license with a clean driving record. Your driver’s license may be checked using an electronic system connected to the DMV where your license was issued. You will not be able to rent a car from Avis if you have any of the following citations within the last 48 months:

  • DUI (driving under the influence)

  • DWAI (driving while alcohol impaired)

  • DWI (driving while intoxicated)

When you pick up your rental car, you may be asked to sign an agreement stating that your driving record meets the standards set by Avis.

What Criteria Does Avis Have for a Renter’s Driving History?

All renters, and anyone else planning to drive the rental car, will be required to present a valid driver’s license showing that the driver meets the minimum age restrictions and has a clean driving record. The license must be current and remain valid through the entire duration of the rental. You will also need to bring a credit card accepted by Avis or a cash rental qualification.

Your Avis rental eligibility will be based on whether you meet the following criteria:

  • Valid license: Your license cannot be suspended, expired, revoked, canceled, or surrendered. 

  • No Reckless Driving: Renters cannot have one or more citations of reckless driving within the last 36 months.

  • No Intoxicated Driving: Renting a car with a DUI, DWAI, or DWI in the last 48 months is prohibited.

  • No Auto Theft: Drivers may not have been in possession of a stolen vehicle.

  • No More Than 3 Moving Violations: This includes seat belt violations.

  • Fewer Than 3 Accidents: Drivers can have no more than 3 accidents in 36 months.

  • Temporary License: This type of license is acceptable only if there are no restrictions during the rental period.

Can you rent a car with a suspended license?

No, Avis requires renters to have a valid license. You also cannot use a license that has been revoked or canceled or that has expired. However, you can use a temporary license as long as it has no restrictions and will remain valid for the entire time you will have the rental vehicle.
